Welcome to Astur Online Shopping ("Astur," "we," "us," or "our"), an online multi-vendor platform that connects customers with vendors for the purchase and sale of goods and services. By accessing or using our website (https://astur.co.ke), mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("T&Cs"). If you do not agree with these T&Cs, you must not use the Platform.
These T&Cs apply to all users of the Platform, including customers, vendors, and any other individuals or entities accessing the Platform ("Users," "you," or "your").
1. General Provisions
1.1 Acceptance of Terms
By registering, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these T&Cs, as well as our Privacy Policy, which is incorporated by reference. We reserve the right to update or modify these T&Cs at any time, and such changes will be effective upon posting on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the updated T&Cs.
1.2 Eligibility
To use the Platform, you must:
Have the legal capacity to enter into a binding agreement.
Not be prohibited from using the Platform under applicable laws.
If you are using the Platform on behalf of a business or entity, you represent that you have the authority to bind that entity to these T&Cs.
2. Roles and Responsibilities
2.1 Astur Online Shopping
Astur operates as a multi-vendor marketplace that facilitates transactions between customers and vendors. We do not own, sell, or control the products or services listed on the Platform unless explicitly stated. Our role includes:
Providing a platform for vendors to list and sell their products or services.
Facilitating payments between customers and vendors.
Offering customer support and dispute resolution services as outlined in these T&Cs.
2.2 Customers
Customers are individuals or entities who purchase goods or services from vendors through the Platform. As a customer, you agree to:
Provide accurate and complete information during registration and checkout.
Pay for all orders in full, including any applicable taxes, shipping fees, or other charges.
Review product descriptions, vendor policies, and return policies before making a purchase.
Use the Platform in compliance with these T&Cs and applicable laws.
2.3 Vendors
Vendors are individuals or businesses who register on the Platform to sell goods or services. As a vendor, you agree to:
Provide accurate and complete information during registration, including business details, licenses, and contact information.
List products or services that are legal, safe, and compliant with all applicable laws and regulations in Kenya and the customer’s jurisdiction.
Clearly state your pricing, shipping, return, and refund policies.
Fulfill orders promptly and ensure products match their descriptions.
Respond to customer inquiries and resolve disputes in a timely manner.
Pay all applicable fees, commissions, or charges owed to Astur as outlined in the Vendor Terms & Conditions below.
3. Account Registration and Security
3.1 Account Creation
To use certain features of the Platform (e.g., purchasing as a customer or selling as a vendor), you must create an account. You agree to:
Provide accurate, current, and complete information during registration.
Keep your account information updated.
Not share your account credentials with others or allow unauthorized access to your account.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You must notify us immediately at info@astur.co.ke if you suspect any unauthorized use of your account
3.3 Account Suspension or Termination
We reserve the right to suspend or terminate your account at our discretion, including for reasons such as:
Violation of these T&Cs.
Fraudulent, illegal, or suspicious activity.
Failure to pay fees or charges owed to Astur.
Providing false or misleading information.
4. Transactions and Payments
4.1 Orders and Fulfillment
Customers: When you place an order, you are making an offer to purchase from a vendor. The vendor is responsible for accepting, processing, and fulfilling your order.
Vendors: You are responsible for fulfilling orders in accordance with the terms you specify (e.g., shipping timelines, product descriptions). Failure to fulfill orders may result in penalties, including account suspension.
4.2 Pricing and Fees
Customers: Prices for products or services are set by vendors and may include additional fees such as taxes, shipping, or handling charges. All fees will be clearly displayed at checkout.
Vendors: You agree to pay Astur a commission or service fee for each transaction, as outlined in the Vendor Terms & Conditions below. Astur reserves the right to deduct these fees from your payouts.
4.3 Payment Processing
Astur facilitates payments between customers and vendors through third-party payment gateways. By using the Platform, you agree to:
Provide accurate payment information.
Authorize Astur and its payment partners to process payments, refunds, or chargebacks.
Comply with the terms of the payment gateway provider.
4.4 Refunds and Returns
Customers: Refund and return requests are subject to the vendor’s return policy, which must be clearly stated on the product listing. Astur may assist in mediating disputes but is not responsible for processing refunds.
Vendors: You must honor your stated return and refund policies. Failure to do so may result in penalties or account suspension.
5. Prohibited Activities
You agree not to engage in any of the following activities on the Platform:
Listing or purchasing illegal, counterfeit, or prohibited items (e.g., drugs, weapons, stolen goods).
Engaging in fraudulent activities, including misrepresentation of products or services.
Using the Platform to distribute malware, spam, or harmful content.
Harassing, threatening, or defaming other users.
Violating intellectual property rights, including selling counterfeit goods or using copyrighted material without permission.
Attempting to hack, disrupt, or interfere with the Platform’s operations.
Astur reserves the right to remove any content or listings that violate these T&Cs and to take appropriate action against the responsible user, including account suspension or legal action.
6. Intellectual Property
6.1 Ownership
All content on the Platform, including text, graphics, logos, and software, is the property of Astur or its licensors and is protected by copyright, trademark, and other intellectual property laws.
6.2 Vendor Content
Vendors grant Astur a non-exclusive, worldwide, royalty-free license to use, display, and distribute any content (e.g., product images, descriptions) you upload to the Platform for the purpose of operating and promoting the Platform.
6.3 Restrictions
You may not copy, modify, distribute, or create derivative works of any content on the Platform without prior written permission from Astur or the respective rights holder.
7. Vendor Terms & Conditions - Astur
7.1 Vendor Eligibility
Vendors must provide accurate business details, including a valid business name and contact information.
Vendors must comply with all local laws and regulations regarding e-commerce and product sales in Kenya and the customer’s jurisdiction.
7.2 Product Listings & Quality
Vendors must upload clear, high-quality images and accurate product descriptions for all listings.
Counterfeit, illegal, or prohibited items are strictly forbidden.
Prices must be transparent, with no hidden fees.
7.3 Commission Structure & Payments
Astur charges a commission based on the total order value as follows:

1,000 - 4,999 Ksh 2%
5,000 - 9,999 Ksh 3%
10,000+ Ksh 4%
Payments to vendors will be processed within 72 hours after order completion.
Astur reserves the right to withhold payments in cases of disputes, fraud, or policy violations.
7.4 Order Fulfillment & Shipping
Vendors must fulfill orders within the agreed time frame and update order status regularly on the Platform.
Late deliveries or failure to ship may result in penalties or account suspension.
Vendors may use Astur’s preferred logistics partners or handle delivery independently, provided they meet delivery timelines.
7.5 Returns & Refunds
Vendors must have a clear return and refund policy in compliance with Astur’s guidelines.
If an item is defective or misrepresented, the vendor must issue a refund or replacement.
Disputes will be reviewed by Astur’s resolution team, whose decision is final.
7.6 Vendor Conduct & Customer Service
Vendors must respond to customer inquiries within 4 hours for orders made before 7 PM on weekdays.
If a vendor does not work on weekends, responses can be made on the next working day.
If a vendor operates on weekends, the same 4-hour response time applies.
Negative feedback due to poor service or product quality may affect the vendor’s visibility on the Platform.
Astur reserves the right to suspend or terminate accounts that violate these terms.
7.7 Marketing & Promotions
Vendors can opt into paid marketing services to boost product visibility.
All promotions must be pre-approved by Astur to maintain fairness and quality.
7.8 Data Protection & Privacy
Vendors must protect customer data and not misuse personal information.
Any breach of data security must be reported to Astur immediately.
7.9 Policy Updates & Amendments
Vendors will be notified of any changes to these terms at least one week in advance.
Continued use of the Platform after updates constitutes acceptance of the new terms.
7.10 Legal & Dispute Resolution
Any disputes between vendors and Astur will first be handled internally.
If unresolved, disputes will be referred to arbitration or legal processes in compliance with Kenyan laws.
By registering as a vendor on Astur, you agree to these Vendor Terms & Conditions.
8. Dispute Resolution
8.1 Customer-Vendor Disputes
Disputes between customers and vendors (e.g., regarding product quality, delivery, or refunds) should first be resolved directly between the parties. Astur may, at its discretion, mediate disputes but is not obligated to do so.
8.2 Platform Disputes
If you have a dispute with Astur, please contact us at support@astur.co.ke to resolve the issue. If the dispute cannot be resolved informally, it will be settled in accordance with the governing law and jurisdiction clause below.
9. Limitation of Liability
To the fullest extent permitted by law, Astur, its affiliates, and its partners will not be liable for:
Any indirect, incidental, or consequential damages arising from your use of the Platform.
Losses resulting from the actions or omissions of vendors, customers, or third parties.
Interruptions, errors, or delays in the Platform’s operation.
Unauthorized access to your account or data, except where caused by our gross negligence.
Astur’s total liability to you for any claim arising from these T&Cs or your use of the Platform will not exceed the amount you paid to Astur in the preceding 12 months.
10. Indemnification
You agree to indemnify and hold harmless Astur, its affiliates, and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from:
Your use of the Platform.
Your violation of these T&Cs.
Your infringement of any third-party rights, including intellectual property rights.
Disputes between you and another user (e.g., customer-vendor disputes).
11. Termination
Astur may terminate or suspend your access to the Platform at any time, with or without notice, for any reason, including violation of these T&Cs. Upon termination
Your account will be deactivated, and you will lose access to the Platform.
Any outstanding payments owed to Astur will become immediately due.
Any rights or obligations that by their nature should survive termination (e.g., payment obligations, indemnification) will remain in effect.
12. Governing Law and Jurisdiction
These T&Cs are governed by the laws of the Republic of Kenya. Any disputes arising from these T&Cs or your use of the Platform will be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
13.4 Entire Agreement
These T&Cs, along with our Privacy Policy and any additional agreements, constitute the entire agreement between you and Astur regarding your use of the Platform.
